"Directorate General of Taxes Speaks Candidly About the Case that Led to AMIN Spokesperson Indra Charismiadji Being Detained by the Prosecutor's Office"

"Dream – The Directorate General of Taxes of the Ministry of Finance stated that the case of alleged tax embezzlement and money laundering involving the Spokesperson for the National Winning Team of Anies Baswedan-Muhaimin Iskandar, Indra Charismiadji, is not a new matter."

The Directorate General of Taxes Speaks Frankly About the Case That Led to AMIN Spokesperson Indra Charismiadji Being Detained by the Prosecutor's Office

The tax evasion case of PT Luki Mandiri Indonesia Raya has been handed over to the East Jakarta Prosecutor's Office (Kejari) in 2019. Another suspect in this case is Ike Andriani. “This is not a new case. Based on data available in the DJP administration system, it is known that during the year 2019 PT LMIR did not fulfill its tax obligations in accordance with tax regulations,” said the Director of Counseling, Services, and Public Relations of the DJP, Dwi Astuti, quoted from Merdeka.com, Thursday, December 28, 2023.

"During the investigation process of this case, Dwi said, stages of supervision have been carried out in the form of appeals to Taxpayers by issuing a Request for Explanation of Data and/or Information (SP2DK) on August 25, 2021. However, Indra Charismiadji, the manager of PT. Luki Mandiri Indonesia Raya, did not respond to the letter, so on May 23, 2023, the process continued with the examination of initial evidence."

“During the initial evidence examination process by the East Jakarta DJP Office, the Taxpayer did not disclose any inaccuracies in actions accompanied by the settlement of the tax shortfall that should have been owed in accordance with the provisions of Article 8 Paragraph (3) KUP,” he said.

"In the examination, indications of money laundering (TPPU) were also found. “Therefore, the preliminary evidence examination has been elevated to the investigation stage,” added Dwi. Moreover, Dwi added, the DJP had informed Nurindra B Charismiadji to utilize the provisions of Article 44B paragraph (2) of the KUP."

“However, it is regulated that the Taxpayer only needs to pay the principal tax plus a penalty fine amounting to 1 times the principal tax. However, this has still not been utilized,” said Dwi. Thus, the East Jakarta DJP Office continues the investigation process by issuing a Notice of Commencement of Investigation (SPDP) notification to the Prosecutor's Office in August 2023.

The case progressed to stage II or the submission of case files and suspects to the DKI Jakarta High Prosecutor's Office on December 27, 2023. “The DJP respects the applicable legal process and is committed to supporting the legal process in accordance with the prevailing laws,” said Dwi.

The national team AMIN believes that Indra Charismiadji is not guilty in the case of alleged tax embezzlement and money laundering (TPPU). That is why the national team AMIN appointed Indra as the Spokesperson or Jubir.

We still believe that he is not guilty. Therefore, we appoint him as the spokesperson,” said the Chairman of the Legal Team of the National Team AMIN, Ari Yusuf Amir, in Jakarta, Thursday, December 28, 2023. Ari confirmed that Indra Charismiadji's status is still as the Spokesperson for the National Team AMIN. He hopes that there are no political elements in the handling of this case.

“Now the question is whether this tool will be used for political pressure or not, that’s the only question. Our hope to law enforcement officials is that they do not play games with the legal realm for political interests,” said Ari. He hopes that law enforcement will be neutral in the 2024 elections, so that the public can trust law enforcement in Indonesia.

“ This event is just a five-year event, but public distrust in you will be dangerous, having a significant impact on law enforcement agencies that are not neutral,” he said.
