Dream - Interfaith marriage does not happen once or twice. However, this phenomenon is still a subject of debate until now. Therefore, it is not uncommon for some people to decide to marry someone of a different religion secretly or to hold the wedding ceremony abroad. According to islam.nu.or.id, in Indonesia itself, legally and formally, marriage is regulated by Law Number 1 of 1974 concerning Marriage and Presidential Instruction of the Republic of Indonesia Number 1 of 1991 concerning Compilation of Islamic Law.
Both of these legislative products regulate issues related to marriage, including interfaith marriages.
Then, what is the actual law regarding interfaith marriage? Because this is important knowledge, especially for Muslims. Here is the explanation as summarized by Dream through various sources.
The Indonesian Ulema Council (MUI) issued a fatwa during the National Assembly II in 1980. MUI made two decisions regarding interfaith marriages.
The following translation preserves the HTML tags: "The scholars in the homeland have decided that the marriage between Muslim women and non-Muslim men is considered forbidden."
Muslim men are prohibited from marrying non-Muslim women. In this case, there are still differences in marriage between Muslim men and women of the People of the Book. "After considering that the harm is greater than the benefit, MUI declares that such marriage is forbidden." explained Prof. Hamka, Chairman of the Second National Assembly of MUI.
The decision on the fatwa, MUI uses the basis from the verse of the Al-Quran in the Al-Baqarah chapter, verse 221 as follows: "And do not marry polytheistic women until they believe. Indeed, a believing slave woman is better than a polytheistic woman, even though she might please you. And do not marry polytheistic men [to your women] until they believe. Indeed, a believing slave is better than a polytheist, even though he might please you. Those invite [you] to the Fire, but Allah invites to Paradise and to forgiveness, by His permission. And He makes clear His verses to the people that perhaps they may remember."
While from the hadith using the following evidence: "Whoever gets married, he has preserved half of his faith, therefore, let him fear Allah in the other half." (HR. Thabrani)
Regarding whether or not Muslim men are allowed to marry women of the People of the Book, there are differing opinions on this matter.
There are some who say it is permissible based on the letter of Al-Maidah verse 5: "On this day, what is good is made lawful for you. The food (slaughtered animals) of those who were given the Scripture is lawful for you, and your food is lawful for them. (Also lawful in marriage are) chaste women from among the believers and chaste women from among those who were given the Scripture before you, when you have given them their due compensation, desiring chastity, not unlawful sexual intercourse or taking [secret] lovers."
"Whoever disbelieves after having believed (not accepting Islamic laws), then erase his deeds and on the Day of Judgment he will be among the losers. Besides that, there is also an opinion that says it is not permissible. In this matter, Muhammadiyah has clarified by saying it is not permissible because the reason is that the people of the book now are not the same as the people of the book in the time of the Prophet Muhammad. The people of the book now have committed polytheism by saying that Uzair is the son of Allah (according to the Jews) and Isa is the son of Allah (according to the Christians)."
Regarding interfaith marriages in Indonesia, this is regulated in Law Number 1 of 1974 concerning Marriage, article 2 paragraph 1:
"
Marriage is valid when conducted according to the laws of each respective religion and belief.
This indicates that the state does not recognize interfaith marriages. Muhammadiyah states that interfaith marriages recorded in the civil registry office are still not valid according to Islam. It is considered as an administrative agreement.
Meanwhile, NU establishes the issue of interfaith marriage in the 28th Muktamar in Yogyakarta in 1989. It is explained that marriages between two individuals of different religions in Indonesia are not valid by law.
