Get Ready, Civil Servants Can Be Transferred If They Fail to Achieve Performance Targets

Dream - Civil Servants (PNS), especially high-ranking officials (PPT), can now be transferred even if they have held their positions for less than two years.

The Government has issued Circular of the Minister of PANRB Number 19/2023 regarding the Mutation/Rotation of High-Level Officials who have not Occupied their Positions for Less than Two Years.

Mutation is carried out by considering the performance of civil servants, which includes work results and employee work behavior, as well as the performance of the work unit. Other considerations include the strategy of accelerating or speeding up the achievement of organizational performance, the ability of the HR department to carry out job duties, and recommendations from the disciplinary violation inspection team.

Minister of State Apparatus Empowerment and Bureaucratic Reform (PANRB), Abdullah Azwar Anas, said that this latest regulation was issued to accelerate the performance of government agencies and encourage the achievement of national development acceleration.

"Rotation/mutation can also be done if there is an element of collision/conflict of interest in the High Leadership Position in Government Agencies."

In Law Number 5/2014 regarding Civil Servants and Government Regulation Number 11/2017 regarding Civil Servant Management, it is regulated that the Apparatus Procurement Officer (PPK) is prohibited from changing the Procurement Committee (PPT) for two years starting from the appointment of the PPT. However, this rule does not apply if the High Ranking Official violates the provisions of the legislation and no longer meets the specified position requirements.

However, on the other hand, the Civil Servant Law and Government Regulation Number 30/2019 regarding Performance Appraisal of Civil Servants also regulates that the results of civil servant performance appraisal are used to ensure objectivity in civil servant development and are used as one of the requirements for job rotation.

This setting aims to ensure that the PPT focuses on achieving the performance of the work unit it leads. If there are potential problems that may result in organizational performance failure, then the PPK is given the space to make position mutations in the PPT.

The authority given to the PPK must be interpreted as a space to accelerate the achievement of national priorities such as poverty reduction, stunting, digital transformation acceleration, and others, through improving the performance of government agencies.
