Verdict of 3 Police Defendants in Kanjuruhan Fatal Tragedy: Former Brimob Polda Jatim Danki Sentenced to 1.5 Years in Prison, Others Acquitted

Dream - The panel of judges at the Surabaya District Court handed down verdicts on the three defendants in the fatal tragedy at Kanjuruhan Stadium in Malang, East Java. The verdict was read at the Surabaya District Court on Thursday, March 16, 2023. 

The three defendants are Danki 3 Brimob Polda Jatim AKP Hasdarmawan, Kasat Samapta Polres Malang AKP Bambang Sidik Achmadi, and Kabag Ops Polres Malang Kompol Wahyu Setyo Pranoto.

According to Merdeka.com, the verdict was read by Chairman of the Panel of Judges Abu Achmad Sidqi Amsya, assisted by panel members Mangapul and I Ketut Kimiarsa.

The judge sentenced former Danki 3 Brimob Polda Jatim AKP Hasdarmawan to 1.5 years in prison. This sentence is half of the prosecutor's demand for a 3-year prison term.

"Imposing a sentence on defendant Hasdarmawan with a prison term of 1 year 6 months, minus time served. Decreeing that the defendant remains in custody," said the judge.

In the verdict, the judge stated that Hasdarmawan was proven guilty beyond a reasonable doubt of committing a criminal act due to negligence, which resulted in the death of others, severe injuries, and injuries of such a nature.

In relation to this, the defendant was found to have violated Article 359 of the Criminal Code, Article 360 paragraph (1), and Article 360 paragraph (2) of the Criminal Code.

Meanwhile, former Kasat Samapta Polres Malang AKP Bambang Sidik Achmadi was acquitted in the Kanjuruhan Tragedy case and was found not guilty of involvement in the case.

In the verdict, the judge stated that the defendant was not proven guilty beyond a reasonable doubt of committing a criminal act due to negligence, resulting in the death of others, severe injuries, and injuries of such a nature.

"Adjudicating that the defendant Bambang Sidik Ahmadi is not proven guilty beyond a reasonable doubt of committing the crimes as stated in the charges 1, 2, and 3," he said on Thursday, March 16, 2023.

Furthermore, the judge also ordered the public prosecutor to immediately release the defendant from custody.

"Acquitting the defendant because the charges brought by the prosecutor were not proven. Ordering the defendant to be released and discharged from custody immediately after this verdict," he said.

In addition to releasing the defendant from custody, the judge also restored all the defendant's rights, along with their dignity and honor.

"Restoring the defendant's rights, dignity, and honor as before," he emphasized.

The defendant stated that they accept the verdict. As for the public prosecutor, they are still considering the verdict.

Furthermore, the other defendant in the Kanjuruhan tragedy, Kabag Ops Polres Malang Wahyu Setyo Pranoto, was also acquitted. He was not proven guilty beyond a reasonable doubt as stated in the previous charges.

Similar to Bambang Sidik Achmadi, Wahyu Setyo will also be released after the verdict is read.

Previously, the three defendants in the Kanjuruhan tragedy case were sentenced lighter than before, with each being demanded a 3-year prison term by the Public Prosecutor.
