"Dream - Chairman of the General Election Commission (KPU) Hasyim Asy'ari has been found guilty of violating ethics for accepting the registration of Gibran Rakabuming Raka as a vice presidential candidate (cawapres) and participating in the electoral process. The Election Organizers Honor Council (DKPP) has issued a final strong warning sanction to Hasyim."

DKPP assesses that Hasyim violated the code of ethics by processing Gibran's registration without changing the minimum age requirement for presidential and vice-presidential candidates according to the Constitutional Court's Decision No. 90/PUU-XXI/2023. The decision was read by DKPP Chairman Heddy Lugito in the verdict hearing of the alleged violation in Gibran Rakabuming Raka's registration as vice-president, Monday, February 5, 2024.

Selain itu, DKPP menjatuhkan sanksi peringatan keras kepada 6 Komisioner KPU, yakni August Mellaz, Betty Epsilo Idroos, Mochamad Afifuddin, Yulianto Sudrajat, Parsadaan Harahap, dan Idham Holik. Dalam pertimbangan putusan yang dibacakan oleh Anggota DKPP I Dewa Kade Wiarsa Raka Sandi, KPU seharusnya segera melakukan konsultasi dengan DPR RI dan pemerintah setelah Putusan MK Nomor 90/PUU-XXI/2023 pada 16 Oktober 2023.

This is necessary so that KPU Regulation Number 19 of 2023 as the technical regulation for the presidential election can be immediately revised due to the impact of the Constitutional Court's decision. "The new defendants submitted a consultation request to the DPR on October 23, 2023, or 7 days after the Constitutional Court's decision was announced," said Wiarsa.

According to Wiarsa, during the trial the defendants argued that they only sent the letter on October 23, 2023 because the DPR (People's Consultative Assembly) was in recess. However, Wiarsa said that the reason given by the KPU (General Election Commission) regarding the delay in requesting consultation with the DPR and the government after the Constitutional Court's decision was not accurate.

Total, there are 4 complaints against all commissioners of the Indonesian General Election Commission (KPU) regarding the ethical matter of Gibran's candidacy. These four cases were filed by Demas Brian Wicaksono (Case number 135-PKE-DKPP/XII/2023), Iman Munandar B (Case number 136-PKE-DKPP/XII/2023), P.H. Hariyanto (Case number 137-PKE-DKPP/XII/2023), and Rumondang Damanik (Case number 141-PKE-DKPP/XII/2023).

Known, on October 25, 2023, the KPU received Gibran's nomination registration file. However, based on KPU Regulation (PKPU) Number 19 of 2023, which at that time had not been revised, Gibran did not meet the requirements because he was not yet 40 years old. The KPU argued that Constitutional Court Decision Number 90/PUU-XXI/2023, which changed the age requirements for presidential and vice-presidential candidates, was sufficient to be used as a basis for processing the nomination of the 36-year-old Mayor of Solo.
