Dream - The Constitutional Court (MK) considers the registration of Gibran Rakabuming Raka as a vice-presidential candidate (cawapres) to be legally valid. MK also found no evidence of President Joko Widodo's (Jokowi) intervention in Gibran's candidacy. This was conveyed by Constitutional Judge Arief Hidayat during the reading of the verdict in the Presidential Election case in 2024 at the MK Building, Monday, April 22, 2024.

Jokowi's Intervention

Arief explained that the constitutional judges consider the petitioner's (Anies-Muhaimin) argument that interprets the decision of the Constitutional Court No. 90/PUU-XXI/2023 as evidence of Jokowi's unreasonable intervention. He further stated that the Court has already provided a clear interpretation of that decision in Decision No. 141/PUU-XXI/2023 and 145/PUU-XXI/2023.

Not only that, the decision of the Constitutional Court No. 90 which nullifies the minimum requirement of 40 years to become a presidential and vice-presidential candidate also immediately applies when it is read.

Therefore, the KPU is still entitled to accept Gibran's nomination even though it has not changed the regulations regarding the minimum age requirements for presidential and vice-presidential candidates.

"Thus, according to the Court, there are no issues regarding the fulfillment of the requirements for Gibran Rakabuming Raka as the vice presidential candidate from the Related Party (Prabowo) and the verification and determination of the candidate pairs conducted by the Respondent (KPU) are in accordance with the provisions."

"The Constitutional Judges also did not find any evidence regarding the Applicant's argument stating the abuse of power by Jokowi in Gibran's candidacy."

Therefore, the Applicant's request to disqualify Gibran as a vice presidential candidate cannot be accepted by the Constitutional Court. "Based on the legal considerations above, the Applicant's argument stating that there was presidential intervention in the change of candidate requirements and the Applicant's argument regarding the alleged bias of the Respondent in the verification and determination of candidate pairs that favored Candidate Pair Number 2, thus becoming the basis for the Applicant to request the Court to cancel (disqualify) the Relevant Party as a participant in the 2024 Presidential and Vice Presidential Election is legally unfounded," concluded Arief.

Arief said that the KPU has received the registration of the candidate pairs in accordance with the decision of the Constitutional Court Number 90/PUU-XXI/2024. Thus, the Constitutional Court also stated that the KPU was not proven to be biased in the process of registering the candidate pairs.
