MA Change the Minimum Age Requirement for Governor and Deputy Governor Candidates to 30 Years, Will Kaesang Be Allowed to Run in the Jakarta Regional Election?

"Dream - The Supreme Court (MA) granted the request regarding the minimum age limit for candidates for governor (Cagub) and Deputy Governor (cawagub) for the 2024 Regional Elections (Pilkada) submitted by the Garuda Party. This regulation is stated in MA Decision Number 23 P/HUM/2024. 'Granting the request for objection to the material test rights from the Applicant, the Garuda Republic Party of Indonesia (Garuda),' as quoted on Thursday, May 30, 2024."

In its decision, the Supreme Court (MA) stated that Article 4 paragraph (1) letter d of the Regulation of the General Election Commission (PKPU) of the Republic of Indonesia Number 9 of 2020 concerning the Fourth Amendment to PKPU Number 3 of 2017 concerning the Nomination of Governors and Deputy Governors, Regent and Deputy Regent, and/or Mayor and Deputy Mayor is contrary to the legislation of Law Number 10 of 2016. The Supreme Court (MA) amended the provision of the minimum age requirement for gubernatorial candidates in the Regional Elections, which was originally set at a minimum age of 30 years from the date of the candidate's announcement, to be counted from the date of the candidate's inauguration.

According to the Supreme Court, Article 4 of PKPU Number 9 of 2020 does not have legal binding power as long as it is not interpreted as a gubernatorial candidate aged 30 years from the date of the pair's determination.

"The minimum age for governor and vice governor candidates is 30 (thirty) years old, and 25 (twenty-five) years old for regent and vice regent candidates or mayor and vice mayor candidates, starting from the inauguration of the elected candidate pair," according to the decision of the Supreme Court. Therefore, the Supreme Court ordered the General Election Commission of Indonesia to revoke Article 4 paragraph (1) letter d of the General Election Commission Regulation Number 9 of 2020 on the Fourth Amendment to the General Election Commission Regulation Number 3 of 2017 on the Nomination of Governor and Vice Governor, Regent and Vice Regent, and/or Mayor and Vice Mayor."

Meanwhile, this decision by the Supreme Court (MA) coincides with the name of the General Chairman of PSI, Kaesang Pangarep, who is rumored to be included in the candidate list for the Deputy Governor of the Jakarta Regional Election 2024. As it is known, Kaesang is currently not yet 30 years old. Therefore, Kaesang will be hindered from running in the election if the KPU (General Election Commission) still enforces the old regulation. Because Kaesang will only turn 30 in December, after the election is held.

Vice Chairman of the Indonesian House of Representatives, Sufmi Dasco Ahmad, uploaded a photo of Budisatrio Djiwandono-Kaesang Pangarep duet on his social media. The post stated as if both of them will be running as the candidate for governor (cagub) and deputy governor (cawagub) in the 2024 Jakarta Regional Election.

In that post, the face of Prabowo Subianto's nephew is displayed, alongside the youngest son of President Joko Widodo (Jokowi), Kaesang. In the background of the photo, there is an image of the National Monument (Monas), known as the symbol of DKI Jakarta.

Not only that, the upload from the Chairman of the Daily Board of the Party also states "For Jakarta 2025". Furthermore, there is also a writing that says "Budisatrio Djiwandono Candidate for Governor of DKI Jakarta" and "Kaesang Pangarep Candidate for Vice Governor of DKI Jakarta", complete with the Jakarta city logo on the top right side of the upload.
