Dream - The Constitutional Court (MK) will hold the first session of the dispute over the 2024 Election on Wednesday, March 27, 2024. This was determined based on the provisions of activities and mechanisms for handling public election dispute cases (PHPU) as stipulated in Constitutional Court Regulation (PMK) Number 4 of 2023 and PMK Number 1 of 2024.

The spokesperson of the Constitutional Court, Judge Enny Nurbaningsih, ensures that Constitutional Judge Anwar Usman will not be involved in handling the case of the Dispute over the Results of the General Election (PHPU) of the 2024 Presidential Election. According to Enny, this is in accordance with the decision of the Honorary Council of the Constitutional Court (MKMK) which deemed Anwar Usman to have committed an ethical violation when deciding on the material test case regarding the age limit of the president and vice president.

"The Honorable Mr. Anwar, in accordance with the Constitutional Court's decision for the Presidential Election, will not participate," said Enny, quoted from Liputan6.com, Monday, March 25, 2024."

Although he is prohibited from handling presidential election disputes, Enny continued, Anwar Usman is still allowed to handle legislative election disputes. However, this does not apply to disputes related to the Indonesian Solidarity Party (PSI). "If he still participates in legislative election disputes, as long as there is no conflict of interest, except for PSI cases," Enny emphasized.

"Arsul Sani"

Enny added, besides Anwar Usman, the constitutional judge who could not attend the hearing for the Legislative Election dispute is Arsul Sani. However, that rule is exempted, specifically for his former party, PPP. "His Excellency Arsul Sani did not participate in the dispute over the results of PPP Legislative Election," she added.

Enny argued that Anwar Usman should not participate in the PHPU Pileg with the PSI applicant and Arsul Sani should not participate in the PHPU Pileg with the PPP applicant, in order to avoid conflicts of interest. It is known that Arsul Sani is a former PPP politician. Furthermore, Anwar Usman has a family relationship with the PSI Chairman Kaesang Pangarep, who is his nephew.

Before the determination of the schedule for the first trial, the Constitutional Court (MK) had already opened the registration period since March 21, 2024. The registration period was open for three days and closed on March 23, 2024.

On the first day of registration, the Legal Team from the presidential and vice presidential candidate pair Anies-Muhaimin arrived earlier at around 09.00 WIB. Meanwhile, on the last day, the Legal Team from the presidential and vice presidential candidate pair Ganjar-Mahfud arrived at around 17.00 WIB. In total, for the dispute of the 2024 Presidential Election, the Constitutional Court (MK) only received two petitions.

Verdict

Later, when the trial has begun, the Constitutional Court (MK) will conduct it in a plenary session for 14 days and will make a decision on April 22, 2024.
