The Minister also asked Apindo to encourage its member companies to implement Minister of Manpower Decree (Kepmenaker) Number 88 of 2023 concerning Guidelines for the Prevention and Handling of Sexual Violence in the Workplace.
“We ask Apindo to actively contribute to the establishment of a Task Force for the Prevention and handling of victims of sexual violence in the workplace,” said the Minister.
Furthermore, the Minister also asked Apindo members to actively participate in social dialogue forums such as Tripartite Cooperation Institutions (LKS) and Wage Councils.
“Employer representatives in the Tripartite Cooperation Institutions and Wage Councils must also actively attend every meeting and be willing to express ideas or suggestions regarding the world of labor,” she concluded.
Previously, the Minister invited all parties to take sexual violence prevention and handling seriously and issued regulations regarding sexual violence.
“Sexual harassment cannot be tolerated. Ida said that this Ministerial Decree is important to be issued because the number of cases and victims of sexual violence in the workplace is still high. Based on data from the National Commission on Violence Against Women, in 2021, there were 389 cases of sexual violence in the workplace with 411 victims; in 2022, there were 324 cases and 384 victims; and until May 2023, there were 123 cases and 135 victims.
In addition, based on an ILO survey on violence and harassment in the workplace in 2022, as many as 70.93 percent of the total 1,173 respondents admitted to having experienced one form of violence and harassment in the workplace. 69.35 percent of the victims experienced more than one form of violence and harassment. Meanwhile, the most common types of violence and harassment experienced by victims are psychological, accounting for 77.40 percent, followed by sexual violence at 50.48 percent. Until now, the number of victims of workplace violence is still dominated by women, with 656 people.
“In addition to the high number of cases and victims, this Ministerial Decree is issued to synchronize and strengthen previous regulations in order to optimize the implementation of prevention and handling of sexual violence in the workplace, as well as to maintain harmonious and productive industrial relations,” she said.
Ida explained that the scope of this Ministerial Decree includes matters related to sexual violence in the workplace; efforts to prevent sexual violence in the workplace; complaints, handling, and recovery of victims of harassment and sexual violence in the workplace; as well as the establishment, functions, and tasks of the Task Force for the Prevention and Handling of Sexual Violence in the Workplace.
