Dream - The Draft Law on State Civil Apparatus (ASN) has officially been approved and become a Law in the Plenary Session of the DPR (People's Consultative Assembly), Tuesday, October 3, 2023. The session was led by the Vice Chairman of the DPR, Sufmi Dasco Ahmad.

This bill is an amendment to Law Number 5 of 2014 concerning the State Civil Apparatus (ASN). In the introduction to the plenary meeting, the Minister of State Apparatus Empowerment and Bureaucratic Reform (PANRB), Abdullah Azwar Anas, highlighted 7 discussion focuses in the latest ASN bill that need to be known by civil servants and honorary employees. "This is part of the commitment of the government, DPR, DPD, local government associations, and various other stakeholders for non-ASN personnel," said Anas quoted from Liputan6.com, Thursday, October 5, 2023. Some of these focuses are related to work culture regulations, transformation of ASN recruitment and positions, ASN performance, ASN career development, ASN competency development, arrangement of non-ASN or honorary employees, and ASN management digitalization.

The following is an important point from the 2023 ASN Law that must be known by civil servants and honorary members, quoted from Liputan6.com.

"Strengthening Work Culture and Institutional Image"

Article 3 outlines the basic values that must be firmly held by Civil Servants, including the Pancasila ideology, loyalty to the state, as well as basic values of Civil Servants such as service-oriented, accountable, competent, harmonious, loyal, adaptive, and collaborative. This is the ethical foundation that must be upheld by all Civil Servants in carrying out their duties.

"Recruitment and Position Transformation of Civil Servants"

This law will provide more flexible space for the recruitment of civil servants. Until now, the recruitment of new employees had to wait once a year. Meanwhile, retirement, resignation, or death can happen at any time. This problem then forces regions to recruit honorary workers and becomes a polemic in the future.

"ASN Career Development"

"Kita tahu bahwa talenta saat ini masih terpusat di kota-kota besar saja. Ada lebih dari 130.000 formasi untuk daerah 3T (tertinggal, terdepan, terluar) pada 2021 tapi tidak terisi," ujar Anas. With this latest law, there will be talent mobility in the future to close the talent gap. Article 46 talks about the career development of civil servants through talent mobility. This mobility can be done within government agencies, between government agencies, or even outside government agencies. The goal is to develop talent that is in line with national needs.

"Arrangement of Non-Civil Service or Honorary Workers"

"Thanks to the support of the DPR, this ASN Bill has become a legal umbrella for the implementation of the main principle of organizing non-ASN personnel, which is the prohibition of mass layoffs, as outlined by President Jokowi from the beginning," said Anas. Article 66 stipulates that the organization of non-ASN or honorary employees must be completed no later than December 2024. After this law takes effect, government agencies are prohibited from hiring non-ASN employees, thus making workforce organization more structured."

The enactment of this bill ensures that everything is safe and they can continue working. In other words, we secure them first so that they can continue working,\u201d

This digitization should also consider the principles of sustainability, confidentiality, and cyber security.
