"Dream - President Joko Widodo (Jokowi) stated that the President's decision (Keppres) regarding the Nusantara Capital City (IKN) has not been completed yet. He has not confirmed when the Keppres will be issued."
"Not yet, I will sign it later," said Jokowi at IKN, East Kalimantan, Wednesday, June 5, 2024 quoted from merdeka.com."
Jokowi said, it is possible that the Presidential Decree will be issued by the elected President Prabowo Subianto. "It could also be the elected president, the new government that signs," he said.
"Previously, the President's Special Staff for Legal Affairs, Dini Purwono, explained that Jakarta is still the capital of Indonesia as long as there is no decision issued by the president regarding the relocation of the capital from Jakarta to the Nusantara Capital (IKN). This is in response to the issue of Jakarta being considered to have lost its capital status following the enactment of the Law on IKN."
"So there is a transitional provision in the IKN Law, namely in Article 39. Based on Article 39 of the IKN Law, DKI Jakarta remains the capital city until the issuance of the Presidential Decree on the relocation of IKN to Nusantara."
word Dini to the journalists, Thursday, March 7, 2024.
"Dream.co.id."
Dini conveyed that regarding when the Presidential Decree (Keppres) will be issued, it is entirely up to the President's authority. According to her, legally, IKN will effectively become the new capital city replacing Jakarta when the Keppres is issued. "When the Keppres is issued, automatically DKI Jakarta will cease to be the capital city," said Dini.
"He explained that the regulations related to that matter are governed by Article 41 of the IKN Law, which states that since the establishment of the Presidential Regulation on the transfer of IKN to Nusantara, the provisions of Article 3, Article 4 except for the function as an autonomous region, and Article 5 of Law Number 29 of 2007 regarding the Government of the Special Capital Region of Jakarta as the Capital of the Unitary State of the Republic of Indonesia are repealed and declared invalid. 'So only certain articles in the DKI Jakarta Law are repealed, not the entire law,' said Dini."
"However, of course, the appropriate timing will be regulated by the government, so that there is not too much time gap between the issuance of the IKN Presidential Decree and the issuance of the DKJ Law so that everything can run smoothly," he explained.
