Same as Strong Ma'ruf, Ricky Rizal Sentenced to 8 Years in Prison

Dream - The defendant in the premeditated murder case against Brigadier J, Ricky Rizal, is sentenced to eight years in prison.

According to the prosecutor, Ricky Rizal violated Article 340 of the Criminal Code in conjunction with Article 55 paragraph 1 of the Criminal Code. The prosecutor assessed that there is no reason for forgiveness and justification for Ricky's actions.

"Demanding that the panel of judges adjudicating the defendant Ricky Rizal Wibowo be found guilty of committing a criminal act. Imposing a sentence of 8 years in prison on the defendant," said the prosecutor at the South Jakarta District Court on Monday, January 16, 2023.

"The defendant must be held accountable and sentenced commensurate with his actions," added the prosecutor.

The aggravating factor for Ricky is that his actions caused Brigadier J to die and caused grief to the victim's family, as well as being convoluted in giving testimony. The mitigating factor is that Ricky has a young child and the guidance of a father.

The prosecutor is convinced that Ricky Rizal, together with Ferdy Sambo, Bharada E, Kuat Ma'ruf, and Putri Candrawathi, planned the premeditated murder of Brigadier J.

The prosecutor said Ricky supported and knew Ferdy Sambo's plan to take Brigadier J's life.

The prosecutor said Ricky also knew that Ferdy Sambo had a plan to kill Brigadier J, but did not prevent it.

"The defendant deliberately did not refuse to call witness Richard Eliezer, the defendant intentionally did not inform Richard that he could meet Sambo and was asked to plan Sambo's intention to shoot the victim. The defendant's role continued by following witness Putri's isolation in Duren Tiga, and even the defendant became the driver of the car with the victim Yosua, sitting and followed by the victim Yosua," explained the prosecutor.

According to the prosecutor, Ricky also did not tell Brigadier J that he had taken a weapon. Ricky also acted as a 'supervisor' for Brigadier J before the shooting incident.

"When Yosua was in the park, the defendant did not want to inform witness FS's plan, so the victim stayed at Duren Tiga. When Sambo deliberately came, the defendant still did not inform the victim, instead the defendant deliberately waited for Sambo's call, then continued with Sambo's summons," he said.

The prosecutor also said that the provision of an iPhone 13 Pro Max and hundreds of millions of rupiah in cash proved convincing evidence of the same intention.

"Thus, the above series clearly shows the defendant's involvement in intentional acts, namely together with other perpetrators, witnesses Ferdy Sambo, Putri Candrawathi, Richard Eliezer, Kuat Ma'ruf, namely desiring the death of Yosua," said the prosecutor.

Previously, the Public Prosecutor (JPU) demanded that the defendant Kuat Ma'ruf be sentenced to eight years in the case of premeditated murder of Brigadier J alias Nofriansyah Yosua Hutabarat.

The demand is based on the premier indictment of Article 340 subsidiary Article 338 in conjunction with Article 55 paragraph (1) ke-1 of the Criminal Code. The punishment is lighter compared to the maximum punishment of the death penalty.

"Imposing a sentence on the defendant Kuat Maruf for eight years minus the period of detention," said the JPU in the demand hearing at the South Jakarta District Court on Monday, January 16, 2023.

The prosecutor believes that Kuat Ma'ruf knew about Ferdy Sambo's plan for the premeditated murder of Brigadier J.

"This information is in accordance with the testimony of witnesses Benny Ali and Susanto Haris from Provos, who come from two different institutions and did not communicate beforehand, so it is impossible for the defendant Kuat Maruf to not know and be involved in taking the life of the victim Yosua Hutabarat," said the prosecutor.

The testimony of those witnesses is also supported by the testimony of a polygraph expert or lie detector test. Therefore, the prosecutor stated that Kuat is suspected of lying when he answered that he did not see Ferdy Sambo shoot Yosua.

"It can be assessed that the defendant Kuat Ma'ruf is involved in planning the taking of Yosua Hutabarat's life," said the prosecutor.
