MK Judge Arief Hidayat Calls 2024 Presidential Election Chaotic: President Not Neutral, Attempts to Nurture Dynasty Politics Spirit

"Dream - Constitutional Court Judge Arief Hidayat assessed that President Joko Widodo (Jokowi) is not neutral in the 2024 Presidential Election (Pilpres). He mentioned that the president's actions seem to nurture the practice of political dynasties in Indonesia."

"In the 2024 Presidential Vice Presidential Election, there was a commotion and uproar caused by the President and his officials openly showing bias and even supporting specific presidential candidates. What the President did seemed to be trying to foster a political dynasty spirit wrapped in a narrow nepotism virus that potentially threatens the future value of democracy."

Arief's words when reading a different opinion or dissenting opinion in the Courtroom of the Constitutional Court, Jakarta, Monday, April 22, 2024.

Arief compares the 2024 Presidential Election with previous years. He evaluates that in the 2004, 2009, 2014, and 2019 Elections, no government interference or manipulation was found. Reflecting on that, Arief, in his dissenting opinion statement, believes that the Constitutional Court (MK) should examine, adjudicate, and decide on disputes over the results of the 2024 Presidential Election not only through a formal legalistic-dogmatic approach that only produces rigid, inflexible, and procedural legal formulations.

"Instead, there is a need for an extensive informal-nonlegalistic punishment that produces a progressive, solutive, and substantive legal formulation when there is a violation of the principles of direct, general, free, secret, honest, and fair elections," he said.

"Previously, Arief Hidayat became one of the Judges who expressed a different opinion or dissenting opinion in the Constitutional Court's decision regarding the dispute of the 2024 Presidential Election, on the lawsuit filed by candidate number 1, Anies Baswedan and Muhaimin Iskandar. Arief mentioned that there had been violations of the Election conducted by President Jokowi and all other government elements in order to win one of the candidates in the 2024 Presidential Election."

"What the government of President Jokowi has done with the entire political structure of ministries and institutions from the central level to the regional level has acted partisan and favored certain candidate pairs," he said.

MK Rejects the Allegation of Lawsuit for the 2024 Presidential Election

MK is known to reject all the arguments of the 2024 Presidential Election lawsuit from the candidate pairs Anies-Cak Imin and Ganjar-Mahfud. With this decision, Candidate number 2 Prabowo Subianto-Gibran Rakabuming Raka still appears as the winner of the most votes as determined by the KPU. The verdict of the case requested by Anies-Cak Imin and Ganjar-Mahfud was read by the Chairman of MK, Suhartoyo.

"Rejecting the applicant's request in its entirety," said Suhartoyo while reading the verdict at the Constitutional Court building, Monday, April 22, 2024."
