Dream - Constitutional Judge Saldi Isra became one of the three judges who expressed a different opinion (dissenting opinion) regarding the decision on the dispute of the 2024 Presidential Election. Saldi stated that the petitioner's argument, Anies-Cak Imin, regarding the politicization of social assistance and the mobilization of state apparatus/officials is legally justified.
Therefore, Saldi Isra assessed that the Constitutional Court (MK) should order a re-voting (PSU) in several regions. "In order to maintain the integrity of honest and fair election organizers, the court should order a re-voting in several regions as mentioned in the legal considerations above," said Saldi at the Constitutional Court Building, Monday, April 22, 2024.
Saldi said, there are two issues that concern him. First, according to Saldi, the issue regarding the distribution of social assistance funds is considered a tool to win one of the presidential and vice presidential election candidates.
Secondly, the issue regarding the involvement of state apparatus, state officials, or organizers in several regions. He considers that both the petitioner's arguments regarding the politicization of social assistance and the mobilization of state apparatus or state organizers are legally justified. As for the Constitutional Court, it has decided to reject in its entirety the dispute petition for the 2024 Presidential Election submitted by candidate number 1 Anies Baswedan-Muhaimin Iskandar (Cak Imin).
"Rejecting the applicant's request in its entirety," said Chairman of the Constitutional Court Suhartoyo during the trial at the Constitutional Court Building, Monday, April 22, 2024. One of the considerations of the Constitutional Court is the argument of Anies-Cak Imin who requested the disqualification of candidate number 2, Prabowo Subianto-Gibran Rakabuming Raka. According to the Constitutional Court, the argument presented by Anies-Cak Imin is not legally justified."
MK also stated that the KPU as the respondent has taken steps in accordance with the regulations in following up on the Constitutional Court's decision which changes the requirements for presidential and vice presidential candidates.
MK also stated the argument that there is nepotism until cawe-cawe from President Joko Widodo (Jokowi) related to the emergence of the Constitutional Court's decision that changes the age requirements for presidential and vice presidential candidates without legal basis.
Then, the Constitutional Court also stated that there is no evidence of the form of Jokowi's "cawe-cawe" conveyed by Anies-Cak Imin in their request with the votes gained by Prabowo-Gibran.
The Constitutional Court judges that President Jokowi's endorsement of Candidate Pair 02 does not violate the law.
