Ferdy Sambo Sentenced to Life Imprisonment

Dream - Former Kadiv Propam of the Indonesian National Police, Ferdy Sambo, has been sentenced to life imprisonment. The prosecutor believes that Ferdy Sambo, along with other defendants, planned and committed premeditated murder against Brigadier J and destroyed electronic evidence.

"To demand that the panel of judges of the South Jakarta District Court who examine and adjudicate this case declare the defendant Ferdy Sambo guilty of intentionally and premeditatedly taking the life of another person," said the prosecutor when reading the indictment on Tuesday, January 17, 2023.

"Imposing a sentence of life imprisonment on Ferdy Sambo," added the prosecutor.

Sambo is believed to have violated Article 340 of the Indonesian Criminal Code (KUHP) in conjunction with Article 55 paragraph 1 sub-paragraph 1 of the KUHP. Sambo is also believed to have violated Article 49 in conjunction with Article 33 of Law No. 19 of 2016 concerning Amendments to Law No. 11 of 2008 concerning Electronic Information and Transactions in conjunction with Article 55 paragraph 1 sub-paragraph 1 of the KUHP.

The prosecutor assessed that there is no justification or excuse for Sambo's actions. The prosecutor stated that Sambo must be held accountable for his actions.

"The defendant Ferdy Sambo can be held criminally liable," said the prosecutor.

An aggravating factor for Sambo is that he took the life of Brigadier J, acted evasively, denied his actions, and tarnished the institution of the Indonesian National Police, involving many police officers. The prosecutor emphasized that there are no mitigating factors in the indictment.

Prosecutor Believes There Was No Harassment in Magelang, Putri Candrawathi and Brigadier J Were Having an Affair

Dream - The Public Prosecutor stated that there was no sexual harassment experienced by Ferdy Sambo's wife, Putri Candrawathi, at their home in Magelang. The prosecutor mentioned that the incident that occurred was an affair between Brigadier J and Putri Candrawathi.

This was stated by the prosecutor when reading the indictment against the defendant Kuat Ma'ruf at the South Jakarta District Court on Monday, January 16, 2023.

The prosecutor stated disagreement with the testimony of the expert witness in psychology from the Indonesian Forensic Psychology Association, Reni Kusuma Wardhani, who stated that there was sexual harassment.

"We respond to the statement of expert Dr. Reni Kusuma Wardhani regarding the presence of sexual violence, which contradicts the testimony of other experts who have taken an oath, such as Aji Febriyanto as a polygraph expert, who stated that witness Putri showed signs of deception during the question 'Did you have an affair with Yosua in Magelang?' which is also stated in the Police Interrogation Report (BAP)," said the prosecutor.

The prosecutor stated that based on the facts acknowledged by the defendant in court, there was no sexual harassment experienced by Putri Candrawathi on July 8, 2022, at Sambo's official residence in the Duren Tiga Police Complex, South Jakarta.

The prosecutor also mentioned that Bharada Richard Eliezer and Sambo's household assistant named Susi were unaware of any sexual harassment in Magelang.

Based on these testimonies, the prosecutor believes that there was no sexual harassment. The prosecutor also stated that there is no testimony indicating that Putri took a shower, changed clothes, or underwent a medical examination after the alleged harassment incident.

"Regarding the testimony of witness Putri Candrawathi that she did not shower or change clothes after the sexual harassment incident, even though there is witness Susi who is her female assistant. Witness Putri Candrawathi also did not undergo a medical examination after the sexual harassment incident, even though she is a doctor who is very concerned about health and hygiene," explained the prosecutor.

"The fact that witness Putri initiated a closed-door conversation with the victim for 10 to 15 minutes after the alleged harassment, and the fact that Ferdy Sambo did not request a medical examination despite his decades of experience as an investigator."

"And the actions of Ferdy Sambo, who allowed witness Putri Candrawathi and the victim to be in the same group and the same car for self-isolation in Duren Tiga, as well as the testimony of Kuat Ma'ruf regarding the 'thorn in the marriage,' it can be concluded that there was no harassment on July 7, 2022, in Magelang, but rather an affair between witness Putri Candrawathi and the victim Yosua Hutabarat," said the prosecutor.

According to the prosecutor, Kuat Ma'ruf was aware of the affair between Brigadier J and Putri and was involved in planning the murder.

"The defendant Kuat Ma'ruf was involved in planning to take the life of Yosua Hutabarat," said the prosecutor.

The prosecutor also mentioned Kuat's testimony in which he asked Putri to report to Sambo to avoid any issues in their marriage. According to the prosecutor, this shows that Kuat was aware of the affair between Yosua and Putri.

"The defendant Kuat Ma'ruf himself, both as a witness and as a defendant, stated to witness Putri Candrawathi to report the victim Nopriansyah Yosua Hutabarat to witness Ferdy Sambo to avoid any issues in the marriage between witness Ferdy Sambo and Putri Candrawathi," said the prosecutor.
