According to Syakh Zainuddin Al-Malibari in the book Fathul Mu'in in the chapter I'anatut Thalibin, it is explained about the rules of eating and drinking when the time of imsak arrives. "Eating is still allowed if one assumes the presence of the night based on ijtihad or information from someone. Likewise (eating is still allowed) if someone is unsure because originally the night is still there. But (eating) is disliked. If a trustworthy person informs him of the dawn, then he must believe it. The same goes for (he must believe) a corrupt person who is strongly suspected of his honesty."
Then, Syekh Bakri Syatha explained that during the time of imsak, it is still allowed for someone to start or finish their pre-dawn meal because the night is still there. "It is permissible to eat the recommended pre-dawn meal, meaning that it is also permissible to eat the pre-dawn meal if someone is doubtful about the continuation of the night. However, Bujairimi said that this rule does not apply to intention because an intention is not valid in doubt unless he suspects that the night is still there with proper ijtihad as has been studied regarding intention and in its commentary because doubt prevents intention."
However, according to Kiai Qusyairi, a Muslim who will fast must still pay attention to the available time seriously. It should not be careless, do not rely solely on the imsak broadcast usually aired in the mosque or mushala. "So, look at the imsakiyah schedule, match the time, it means he must make ijtihad there. Don't just rely on the broadcast, because, you know, people can make mistakes," he said.
Apparently, the imsak time that only exists in Indonesia is an initiative of the Nusantara scholars in managing the fasting matters of the people. Although it is never explained in the literature books. According to Kiai Qusyairi, the fasting time begins at the dawn of shadiq or subuh time. However, many of us never know what shadiq dawn is like. Therefore, the Nusantara scholars set a time interval before the dawn of shadiq as the imsak time for caution.
Thus, if there are still those who question the timing of imsak, then it is regrettable. They claim that there was no imsak time during the time of the Prophet. Whereas it is clear that the imsak time is very beneficial for laypeople like us to remind ourselves before entering the fasting period. "This is the initiative of our scholars as a solution to the community, don't just be able to criticize innovations," said Kiai Qusyairi.
