Dream - Minister of Manpower, Ida Fauziah, will issue a circular letter (SE) that regulates this obligation to employers.
Ida emphasizes that the THR payment must be made no later than one week or 7 days before the Eid al-Fitr holiday.
Quoting Minister of Manpower Regulation Number 6 of 2016, THR Keagamaan is a non-wage income that must be paid by Employers to Workers/Laborers.
Quoting Merdeka.com, in Article 2, paragraph 1 of Minister of Manpower Regulation No. 6 of 2016, it is stated that employers are obliged to provide Religious Holiday Allowance (THR) to workers/laborers who have been employed for 1 month, continuously, or more.
In clause 2, it is also written that Religious Allowance must be given to employees\/workers who have employment relationships based on indefinite work agreements (PKWTT), definite work agreements (PKWT). Religious Allowance also applies to daily casual workers who meet the requirements according to regulations.
The amount or quantity of religious THR grants is determined in Article 3, which states that the amount of THR for Workers/Workers with 12 months of continuous work and beyond is given one month's wages. "Workers/Laborers who have worked continuously for 12 (twelve) months or more are given one month's wages," the policy states.
Workers/Laborers who have worked for 1 (one) month continuously but less than 12 months, will be given proportionally according to their length of service with the calculation: length of service x 1 (one) month wage. This is quoted from Article 3 paragraph 1 of Minister of Manpower Regulation Number 6 of 2016. The one month wage referred to consists of components: Wage without allowances which is the net wage (clean wage), or Basic Wage including fixed allowances.
"Meanwhile, Workers/Laborers who work based on daily wage agreements, monthly wages are calculated based on:"
a. Workers/Laborers who have been employed for 12 (twelve) months or more, their salary for 1 (one) month is calculated based on the average salary received in the last 12 months before the Religious Holiday, write Permanker Number 6 Year 2016. Furthermore, Workers/Laborers who have been employed for less than 12 months, their salary for 1 month is calculated based on the average salary.
